Welcome to Pose.ae ("Pose," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Pose.ae website and services. By accessing or using our website, you agree to be bound by these Terms.
1. ACCEPTANCE OF TERMS
By accessing, browsing, or making a purchase from pose.ae, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which explains how we collect, use, and protect your personal data, including your rights under applicable data protection laws.
2. ABOUT POSE
Pose is the UAE's premier curated marketplace for authentic fashion, home, and lifestyle pieces from emerging regional designers and artisans. We bridge the gap between hidden creative gems and intentional shoppers worldwide, supporting responsible shopping and slow fashion. Every piece we curate embodies passion, originality, style, and exclusivity.
We are based in Dubai, United Arab Emirates, and operate exclusively through our e-commerce platform powered by Shopify.
Legal Information Our registered trading name is Pose Fashion LLC FZ, with business registration number 2537072, registered at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, United Arab Emirates.
3. ELIGIBILITY
You must be at least 18 years of age to make purchases from Pose.ae. By placing an order, you represent and warrant that you are of legal age to form a binding contract.
4. ACCOUNT REGISTRATION
4.1 Account Creation
Whilst you may browse our website without an account, creating an account provides benefits including faster checkout, order tracking, and exclusive member offers. To create an account, you must provide accurate and complete information.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Notify us immediately of any unauthorised use of your account
• Not share your account credentials with others
4.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.
5. PRODUCT INFORMATION AND AVAILABILITY
5.1 Product Descriptions
We strive to ensure all product descriptions, images, and measurements are as accurate as possible. Colours may vary slightly due to screen settings, and dimensions are approximate. In the event of a material error, we will work with you to find a suitable resolution.
5.2 Pricing
All prices are listed in UAE Dirhams (AED) and are subject to change without notice. We reserve the right to correct pricing errors on our website or on pending orders.
5.3 Availability
Product availability is subject to change. If an item becomes unavailable after you place an order, we will notify you and offer a refund or suitable alternative.
5.4 Authenticity
Every item is supplied by our vetted partner designers and verified against their credentials and authorisation to sell.
5.5 Product Warranties
All products sold on Pose.ae are covered by the warranty provided by the relevant designer or manufacturer, and in all cases for no less than the period required under UAE Federal Law No. 15 of 2020 on Consumer Protection.
If you receive a defective item or one that does not match its description, please contact us at customercare@pose.ae within 14 days of delivery with your order number, a description of the issue, and supporting photos. Where a defect is confirmed, we will offer a repair, replacement, or refund as appropriate.
Warranties do not cover normal wear and tear, accidental damage after delivery, or damage resulting from improper use or care.
Our 100% authenticity guarantee applies to all items. If any product is found to be inauthentic, you are entitled to a full refund regardless of the return period.
6. ORDERS AND PAYMENT
6.1 Placing Orders
By placing an order, you make an offer to purchase the product(s) at the price stated. We reserve the right to accept or decline your order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.
6.2 Order Confirmation
Upon placing an order, you will receive an email confirmation. This confirmation does not constitute our acceptance of your order. Order acceptance occurs when we ship the product(s) or provide shipment notification.
6.3 Payment Methods
We accept the following payment methods:
• Visa, Mastercard, and American Express credit and debit cards
• Apple Pay
6.4 Payment Processing
All payments are processed through secure, encrypted payment gateways. We do not store complete credit card information on our servers.
6.5 Payment Authorisation
By providing payment information, you authorise us to charge the total amount of your order, including applicable taxes and shipping fees.
6.6 Order Modifications and Cancellations
Once an order is placed it is passed immediately to our partner designer for fulfilment and we cannot guarantee cancellation. If you change your mind, contact us straight away at customercare@pose.ae or call/WhatsApp +971 52 9907673 and we will do our best to help. If we cannot cancel before dispatch, our Returns Policy applies.
Pre-order items are made to order and cannot be cancelled once the order has been placed.
7. PROMOTIONAL CODES AND DISCOUNTS
7.1 Use of Codes
Only one promotional code may be applied per order. Promotional codes cannot be combined with other offers or used on items already on sale unless specifically stated.
7.2 Terms and Conditions
Each promotional code may have specific terms and conditions, including minimum purchase requirements, expiration dates, and product exclusions. These terms will be communicated at the time the code is issued.
7.3 First-Time Customer Discount
New customers receive 10% off their first order with code WELCOME10, subject to applicable terms and conditions.
7.4 Regulatory Compliance
All promotions and discounts offered by Pose are subject to applicable UAE regulatory requirements and any necessary approvals from the relevant competent authority.
8. SHIPPING AND DELIVERY
Full details of our shipping and delivery terms, including estimated delivery timeframes by region, risk of loss, and our policy on failed or delayed deliveries, are set out in our Shipping Policy. By placing an order, you agree to those terms.
For pre-order items, standard delivery timeframes do not apply until the item is dispatched; the lead time for each pre-order item is stated on the individual product page.
9. RETURNS AND EXCHANGES
Consumers have the right to return or exchange goods purchased through Pose.ae in accordance with UAE Federal Law No. 15 of 2020 on Consumer Protection. Full details of how to initiate a return or exchange, applicable timeframes, and any exclusions are set out in our Return Policy. By making a purchase, you agree to those terms.
10. INTELLECTUAL PROPERTY RIGHTS
10.1 Ownership
All content on pose.ae, including but not limited to text, graphics, logos, images, photographs, audio clips, digital downloads, and software, is the property of Pose, our partner designers, or our licensors and is protected by international copyright, trademark, and other intellectual property laws.
10.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable licence to access and use our website for personal, non-commercial purposes. You may not:
• Reproduce, distribute, or publicly display any content from our website without permission
• Modify or create derivative works from our content
• Use any automated system or software to extract data from our website (scraping)
• Use our content for commercial purposes without authorisation
10.3 Designer Content
Products, images, and designs created by our partner designers remain the intellectual property of those designers. Purchasing a product does not transfer intellectual property rights.
11. LIMITATION OF LIABILITY
11.1 Disclaimer of Warranties
Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms limits or excludes any rights you have under applicable consumer protection law, including UAE Federal Law No. 15 of 2020.
11.2 Limitation of Liability
To the maximum extent permitted by law, Pose shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages. Nothing in these Terms limits or excludes any rights you have under applicable consumer protection law, including UAE Federal Law No. 15 of 2020.
11.3 Maximum Liability
In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you for the product(s) giving rise to the claim.
12. GOVERNING LAW AND DISPUTE RESOLUTION
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai.
12.2 Dispute Resolution
Any disputes arising out of or relating to these Terms or your use of our website shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
12.3 International Customers
Nothing in these Terms limits or excludes any mandatory rights you may have under the laws of your country of residence.
